Terms & Conditions 1. Introduction Quickker is a survey builder software operated by SAM Projekt Biro d.o.o. ("the Company" or "Quickker"). This document sets out the Terms & Conditions that apply to the use of the services on the www.Quickker.com domain ("Quickker"). By using these services you affirm that you accept these Terms & Conditions and agree that your use of Quickker will be governed by these Terms & Conditions. You should read these Terms & Conditions carefully before using Quickker as they contain important legal information that may affect your rights. Quickker reserves the right at its sole discretion to amend these Terms & Conditions, and will notify you of amendments by posting them on the Terms & Conditions page of the Quickker site. If you do not accept these Terms & Conditions you should not continue to use the Quickker service. It is the responsibility of all Quickker users, whether members or non-members, to check the Terms & Conditions page of the Quickker site in order to be aware of any amendments to these Terms & Conditions. By continuing to use the Quickker service, you affirm that accept any amendments to these Terms & Conditions. New functions and content may from time to time be added to Quickker. These will also be subject to these Terms & Conditions unless specifically stated otherwise. Your use of new functions and content indicates your acceptance of the Terms & Conditions that apply to them. 2. Eligibility In order to use Quickker you must be over the age of 13. To access certain content and features of Quickker you must first register as a member and submit the required personal information. Users between the ages of 13 and 18 should have the consent of a parent or guardian before registering as a member of Quickker. In any event, no person below the age of 13 should register as a member of Quickker. Quickker does not solicit personal information from anybody below the age of 13. If you believe that your child who is below the age of 13 has registered with Quickker and shared their personal information, please contact us. 3. Registration Information & Account Security As a registered member of Quickker, you agree to provide accurate and up-to-date information during registration and to keep this information up to date. Failure to provide the required information may result in inability to access certain content and functions, resulting in an incomplete Quickker experience. As a registered member of Quickker, you agree to keep your Quickker account and login details secure, and to log out promptly at the end of a Quickker session to help ensure the security of your account. You should notify Quickker immediately if you believe anyone is using your Quickker account without authorization. You are responsible for all activity carried out using your account. Quickker will not be responsible for any losses or damages that occur as a result of unauthorized use of your account. Quickker respects your privacy and will not share your personal information unless required to by law. 4. Proprietary Rights Registered members have the ability to post content (e.g. lists) to Quickker. This content will be made public when you give permission. It is within your control whether or not to make the content you post public. Although you retain copyright in content you post, by posting it you grant Quickker certain rights for the use of that content. When you post content that is not to be made public, you grant Quickker the right to store and aggregate that content and to use it in profile matching and to deliver appropriate search results and recommendations. However the actual content you post will at no time by displayed or made public, it will be used only to establish a relationship; private content will always remain private. When you choose to make content public, you grant Quickker the right to make that content public and to display it on the Quickker site. You also grant other Quickker users the right to duplicate ("snag") that content, either in part or in whole, and to amend and re-display it. You accept that should you choose to delete content you have made public, any duplicate or amended versions that other users have chosen to snag will not be deleted. 5. Trademarks The Quickker name, logo and domain name are protected trademarks and may not be reproduced or used without the written consent of the Company. This includes usage as part of other logos or domain names. 6. User Code of Conduct Quickker is a list sharing site and social recommendation site, based on the honestly held opinions submitted by its members in good faith. Although Quickker does not exercise control of the content posted by members, it does require members to follow a code of conduct. By accessing Quickker, users agree to abide by the code of conduct set out below.
7. User Content Users are solely responsible for all content they post to Quickker. Users may not post content which they do not have permission to post; this includes, but is not limited to, material for which copyright lies with a third party. Quickker does not accept responsibility for monitoring content posted by users, but reserves the right to do so at its sole discretion. Quickker may remove any content it chooses if it considers content is in violation of these Terms & Conditions, or for any other reason or without reason Users may remove the content they post at any time, but it is agreed that snagged versions of user lists may not be removed. Quickker may retain archived versions of deleted content, but this will not be made available on the website Quickker does not endorse any content posted by users and does not make any warranties or representations as to the accuracy or completeness of content posted by users. Quickker will not be responsible for any losses or damages that result from recommendations made by Quickker users. Quickker should not be used as the sole basis for selecting products or services. In the case of certain products and services, including, but not limited to, medical and financial products and services, users should always seek expert advice and should in no circumstances make decisions based solely on information contained in Quickker. You agree that by using Quickker you may be exposed to offensive, indecent or objectionable material and accept that Quickker bears no responsibility for such material. Users are advised to be careful about the content they post and to ensure that it does not in any way compromise their security, either online or offline. Users are responsible for checking the content and applicability of any lists they snag from other users. 8. Data Storage Quickker is not obliged to store content posted by Users, and makes no warranties that such content will not be deleted, either through accidental loss or through deliberate deletion when Quickker believes that content or User behaviour is in violation of these Terms & Conditions, or for any other reason or for no reason. Users are strongly advised to retain private back-up copies of their own content. 9. Copyright Complaints Quickker does not solicit the uploading of any material by Users that infringes the copyright of any third party individual or organization. If you believe any content contained on Quickker is in violation of copyright, please contact us. 10. Repeat Violation Policy Quickker reserves the right to terminate the account of any User who repeatedly violates these Terms & Conditions. 11. Third-Party Websites Quickker may contain links to third-party websites and content. The Company is not responsible for the content of these websites, or for their Terms & Conditions or Privacy Policies. 12. User Disputes Users of Quickker are solely responsible for all their interactions with other users. Quickker reserves the right but is not obliged to monitor all disputes between users of the Quickker service. 13. Privacy Policy We respect your privacy. Quickker provides Terms & Conditions and a Code of Conduct for posting materials, however Quickker does not control content that is posted and is not responsible for any materials posted by users, nor is it responsible for the conduct of users, either online or offline. Quickker may occasionally be temporarily unavailable due to site maintenance or for other reasons. Quickker assumes no responsibility for any error, interruption, omission, defect, deletion or delay in operation or transmission, failure of communication line, theft or destruction or unauthorized access to, or alteration of, user communications. Quickker is not responsible for any technical malfunction or other problems of any telephone or other communications network or service, computer systems, servers or providers, computer or mobile phone equipment, software, or for failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to the user's or to any third party's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Internet and/or in connection with Quickker, including any Mobile Client software. Under no circumstances will Quickker be responsible for any loss or damage, including but not limited to any loss or damage to any content posted by users, or personal injury or death, resulting from anyone's use of Quickker or any content posted on Quickker or transmitted to users, or any interactions between users, whether online or offline. This clause does not cover the extremely unlikely event of fraud committed by an employee of Quickker or death or personal injury caused by negligence on the part of Quickker. Quickker AND ALL SITE CONTENT ARE PROVIDED "AS-IS" AND THE COMPANY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. THE COMPANY CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF Quickker. THE COMPANY DOES NOT REPRESENT OR WARRANT THAT CONTENT OR MATERIALS ON Quickker ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE OR THAT Quickker'S CONTENT AND SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR MALIGNANT CODE. Quickker ADVISES THAT YOU SHOULD EXERCISE CAUTION IN THE USE OF ANY CONTENT AND EMPLOY INDUSTRY-RECOGNIZED SOFTWARE TO DETECT AND QUARANTINE VIRUSES. YOU UNDERSTAND AND AGREE THAT YOU ACCESS CONTENT, MATERIAL AND DATA FROM OR THROUGH Quickker AT YOUR OWN RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR YOUR USE THEREOF AND ANY DAMAGES TO YOUR MOBILE DEVICE OR COMPUTER SYSTEM, LOSS OF DATA OR OTHER HARM OF ANY KIND THAT MAY RESULT. 15. Limitation on Liability IN NO EVENT WILL Quickker OR ITS DIRECTORS, EMPLOYEES, AGENTS OR REPRESENTATIVES BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF Quickker AND THE CONTENT Quickker CONTAINS. IF YOU ARE DISSATISFIED WITH THE Quickker SERVICE, OR HAVE ANY ISSUE WITH THESE TERMS & CONDITIONS, YOUR SOLE RECOURSE IS TO DISCONTINUE USING THE Quickker SERVICE. 16. Termination Quickker reserves the right to terminate User accounts and delete content for any or no reason. 17. Governing Law Users agree to be governed by the laws of England and Wales. Users also agree to abide by any applicable laws in their own jurisdictions and to ensure that their use of Quickker does not contravene any such laws. 18. Indemnity Users agree to indemnify and hold Quickker, its subsidiaries and affiliates, and their directors, officers, agents, contractors, partners and employees, from and against all claims and liabilities (including claims by third parties), including costs and expenses (including legal fees), arising out of or in connection with any content posted by Quickker users, or any content users choose to post or share on or through Quickker, users' use of Quickker, conduct in connection with Quickker or with other users of Quickker, or any violation of these Terms & Conditions or of any law or the rights of any third party. 19. Quickker User Terms Individual voter data that is older than 3 months will be automatically deleted from our database. This applies only to Quickker FREE account. Survey responses do not add up month to month for ANY account type. Each month the number of available responses is reset to the amount agreed for that account type. We reserve the right to delete any free account that has not been logged into for 6 month or longer. When a free account users survey responses run out, surveys relating to that account will automatically close. Pro account users will be charged $0.03 per response collected after their 1000 monthly responses have been used. These extra charges, if incurred will be added on to the next monthly bill received. 20. Quickker Affiliate Programme
